Please take note of the following General Terms and Conditions. They govern the legal relationship between you and Stattreisen Hamburg e.V. and, insofar as they are legally valid, form an integral part of our contract for the agreed services.

1. Registration and conclusion of contract
1. By registering, which can be done verbally, in writing, by email or via the Internet, the customer makes a binding offer to Stattreisen Hamburg e.V. to conclude a contract on the basis of the service description and these General Terms and Conditions.
2. The contract is concluded upon confirmation by Stattreisen Hamburg e.V. This confirmation does not require any specific form, but will usually be made in writing.
- In the case of verbal registration, acceptance of these General Terms and Conditions shall be deemed to have taken place, unless otherwise stated in the offer from Stattreisen Hamburg e.V.,
- by personally taking note of the copy presented on site or
- after expressly waiving prior knowledge and agreeing to the subsequent submission.
3. In the case of public offers from Stattreisen Hamburg e.V., the contract shall be concluded upon participation.
The General Terms and Conditions apply insofar as they are part of the public offer.
4. Unless otherwise provided by international or European law, German law shall apply exclusively.
2. Services and changes to services
1. The scope of services is generally based on the service description provided by Stattreisen Hamburg e.V. and any additional agreements that may have been made.
2. Subsidiary agreements require written confirmation by Stattreisen Hamburg e.V.
3. Deviations from the contractually agreed service content and scope on the part of Stattreisen Hamburg e.V. are only permissible if the changes are not significant and do not affect the overall design. Stattreisen Hamburg e.V. shall inform its contractual partners immediately of any necessary changes.
4. The number of participants should not exceed 30. Any exceedances must be agreed separately.
5. Stattreisen Hamburg e.V. reserves the right to stipulate a minimum number of participants for certain services.
3. Prices for pre-contractual and contractual services and payment methods
1. Prices are based on the current price list and do not include VAT in accordance with Section 4 of the German Value Added Tax Act (UStG).
2. Prices are based on the agreed services and number of participants. Any excess will be charged according to the valid price list. Additional services (e.g. admission fees, transport costs, parking fees, catering costs, visitor's tax/levies) are to be paid separately.
3. In principle, the customer receives an invoice from Stattreisen Hamburg e.V. with the order confirmation and pays in advance.
4. In agreed cases and for tours offered publicly by Stattreisen Hamburg e.V., payment is due in cash at the beginning of the service and must be made to the tour guide.
5. For pre-contractual services (written service offers, service proposals, programme coordination), a processing fee based on the amount of work involved will be charged, which will be credited to the agreed price if the contract is concluded.
6. Stattreisen Hamburg e.V. may charge a fee to be agreed upon for rebooking agreed services or dates.
4. Cancellation/non-utilisation of services by the customer
7. The guest may withdraw from the contract at any time after it has been concluded. The date of receipt of the notice of withdrawal by Stattreisen Hamburg e.V. shall be decisive.
8. If the customer withdraws from the contract or fails to keep an agreed appointment, Stattreisen Hamburg e.V. shall be entitled to reimbursement of expenses, which shall be claimed as a lump sum as follows:
- 20% of the agreed price from 30 to 15 working days* before the agreed date
- 50% of the agreed price from 14 to 3 working days* before the agreed date
- 100% of the agreed price thereafter

9. Weather phenomena such as snow, rain, storms, etc. are not a reason for us to cancel the booked programmes. In special cases, you can rebook the programmes free of charge up to 48 hours before the programme date if severe weather is forecast. We do not reimburse costs.
In the event of cancellation of programmes including boat hire, separate
cancellation rules apply to our partner. These are as follows:
- 40% from the 59th to the 30th working day* before the agreed date
- 50% from the 29th to the 15th working day* before the date
- 14 to 3 working days* before the date: 80%
- After that: 100%
of the agreed price.
*Cancellations can only be accepted by Stattreisen Hamburg e.V. during office hours, Monday to Friday, 9 a.m. to 4 p.m. They must be made in writing (by post or email). The cancellation deadlines apply to these office hours. Saturdays, Sundays and public holidays are not considered working days.
10. If the customer is more than 30 minutes late, there is generally no entitlement to services. If services are nevertheless provided, the agreed price remains payable without deduction.
The customer's request to make up for the lost time will be accommodated if possible and in consultation between the customer's contact person and the tour guide, subject to payment of an additional fee based on the current price list of Stattreisen Hamburg e.V.
11. If the services are terminated prematurely at the customer's request, the agreed price is payable in full.
12. The return or exchange of event tickets purchased in advance is generally excluded. The tickets are transferable and not personalised.
5. Cancellation/withdrawal by Stattreisen Hamburg e.V.
1. Stattreisen Hamburg e.V. reserves the right to cancel/withdraw from the contract in whole or in part in the following cases:
a. if the specified minimum number of participants is not reached
- in the event of force majeure
- in the event of acute illness of the tour guide without the possibility of replacement
In these cases, both parties shall be released from their obligations.
b. if the customer or participants in a group persistently disrupt the performance of the service,
despite a warning
- if the customer or participants behave in a manner contrary to the contract or grossly negligently disregard safety instructions from the service offer or during the provision of the service
- if participants are unable to meet the programme requirements due to misjudgements of their abilities.
In these cases, Stattreisen Hamburg e.V. shall retain its claim to the agreed price; if justified, any expenses saved shall be taken into account.
6. Liability
1. Stattreisen Hamburg e.V. is liable for the agreed price for the conscientious preparation, the careful selection of tour guides, the accuracy of the
service descriptions and the proper provision of the contractually agreed services.
2. Stattreisen Hamburg e.V. is not liable for services that are arranged as third-party services from other service providers (e.g. bus companies, catering establishments, etc.), but is liable for their proper arrangement.
3. The customer is obliged to cooperate in the event of service disruptions in order to avoid or minimise any damage. In particular, the customer is obliged to notify Stattreisen Hamburg e.V. immediately of any agreed services that are defective or missing.
4. Liability on the part of Stattreisen Hamburg e.V. relates to the agreed services and is excluded for damages that are not physical injuries, unless they were caused intentionally or through gross negligence.
5. In the case of tours for children and young people, neither Stattreisen Hamburg e.V. nor the tour guide assumes any duty of supervision; accompanying personnel are required.
7. Limitation period
1. Claims by the customer against Stattreisen Hamburg e.V. shall generally become time-barred after one year, beginning at the end of the year in which the claim arose.
2. Claims arising from tort shall remain unaffected by this.
8. Data protection
1. The customer agrees that the data provided by them may continue to be used by Stattreisen Hamburg e.V. for customer service purposes.
2. The responsible body within the meaning of data protection laws, in particular the EU General Data Protection Regulation (GDPR), is: Stattreisen Hamburg e.V., Martyn Leder, Kuhberg 2, 20459 Hamburg

if we are not yet permitted to delete your data due to legal obligations

3. If you have given us your consent, you can revoke it at any time with effect for the future. You can contact your competent supervisory authority at any time with a complaint. Your competent supervisory authority depends on the federal state of your residence, your work or the alleged infringement.
9. Place of jurisdiction
1. The customer may only bring legal action against Stattreisen Hamburg e.V. at its general place of jurisdiction, i.e. Hamburg.
2. For legal action taken by Stattreisen Hamburg e.V. against the customer, the customer's general place of jurisdiction shall apply.
If the customer is a merchant or a legal entity under public or private law, or if the customer does not have a general place of jurisdiction in Germany, the place of jurisdiction for legal action taken by Stattreisen Hamburg e.V. shall be its registered office, i.e. Hamburg.
10. Severability clause
The possible invalidity of individual provisions shall not result in the invalidity of the remaining provisions or of the contract as a whole.
